Legal guarantee of conformity

1. Consumers in the European Union

All goods we sell are covered by the legal guarantee of conformity under Legislative Decree no. 170/2021, which implements Directive (EU) 2019/771 in the Italian Consumer Code (Articles 128 to 135-septies).

• Duration: the seller is liable for any lack of conformity existing at the time of delivery and becoming apparent within 2 years of delivery.
• Presumption: any lack of conformity that becomes apparent within 1 year of delivery is presumed to have existed at the time of delivery, unless proven otherwise.
• Time limit for legal action: the consumer's action is subject to a limitation period of 26 months from delivery.

Remedies

Where goods are not in conformity you are entitled, in this order, to:

1. repair or replacement, free of charge, within a reasonable time and without significant inconvenience;
2. a proportionate price reduction or termination of the contract where repair or replacement is impossible, disproportionate, not carried out within a reasonable time, or the defect recurs.

Termination is not available where the lack of conformity is only minor. Costs of return, postage and labour for a valid conformity claim are borne by us.

Hand-made goods

Our canvases are printed and finished by hand. Slight variations in shade, print registration and texture between pieces are an intrinsic characteristic of the craft and do not constitute a lack of conformity. Please follow the care instructions supplied with the product.

2. Customers in the United States

U.S. law does not provide an equivalent statutory two-year guarantee. Sales to U.S. customers are covered by the implied warranties of merchantability and fitness for a particular purpose to the extent they apply, and by our commercial policy: [TO BE COMPLETED – describe the commercial warranty offered, if any. 3. How to make a claim

Write to info@stamperiabertozzi.it with your order number, a description of the defect and photographs. We reply within 2 business days.
